Judicial rulings in Peru and Bolivia affect Maricsa Alfaro and Tatiana Marset
In Peru, the Second Criminal Appeals Chamber of La Libertad ordered the release of Maricsa Polet Alfaro Cerna, an entrepreneur convicted of causing the death of security guard Juan Martínez Torres in a vehicle accident in Trujillo. The court modified her sentence from effective prison time to two years of suspended imprisonment. The decision cited her lack of criminal record, her cooperation with police, and her previous payments toward civil reparations. As part of her release, Alfaro must pay S/ 400,000 in civil reparations, adhere to specific conduct rules, and remains permanently disqualified from driving. The accident, which occurred in May 2026, involved Alfaro driving under the influence of alcohol.
In Bolivia, a court in Santa Cruz annulled the arrest warrant and the declaration of rebellion against Tatiana Marset. Her defense successfully argued through an ‘Acción de Libertad’ that her failure to attend a recent judicial hearing was due to a medical emergency involving an internal hemorrhage. While the arrest order was revoked, Marset remains under house arrest and is currently hospitalized in a private clinic under police custody while she recovers.
