Peruvian deputy proposes law to criminalize apology for crime during social conflicts

Aldo Antonio Bravo Quispe, a deputy from the Renovación Popular party, has introduced a legislative project to criminalize 'apology for crime' during periods of political crisis or social conflict in Peru. The proposal seeks to amend the Penal Code to introduce aggravating circumstances for those who use media, digital platforms, or public influence to promote or justify the use of explosives, incendiary devices, or dangerous substances.

Under the proposed law, individuals could face prison sentences ranging from four to six years. The initiative specifically targets journalists, digital content creators, influencers, and public officials, with the latter facing additional disqualification from office.

The Consejo de la Prensa Peruana (CPP) has formally rejected the proposal, warning that its imprecise language could violate constitutional rights to freedom of expression and information. The CPP argued that the lack of a clear legal definition for a 'political crisis' could lead to the criminalization of legitimate journalistic reporting on public interest events, such as protests and social mobilizations.
