Peru mayors use loophole to sidestep re‑election ban
Peruvian law expressly prohibits immediate re‑election of mayors and regional governors. The legislation, however, does not bar former mayors from running for other elected offices such as first councilor, regional councilor, provincial mayor or governor. Officials exploit this by registering as first councilor, then assuming the mayoralty if their list wins after the original mayoral candidate resigns.
At least 53 such cases have been documented nationwide, with three notable examples in the Arequipa region: Paucarpata (Marco Antonio Anco Huarachi), Mejía (Diana Sosiire Aspilcueta Cáceres) and Islay (Richard Hitler Ale Cruz). The Jurado Nacional de Elecciones (JNE) president Roberto Burneo said the JNE can only apply existing law and cannot impose additional restrictions, noting that around 60 local authorities are currently using these mechanisms. Burneo announced plans to propose legislative reforms and called for a broad debate on electoral rules. He also defended the possibility of mayoral re‑election in comments about Rafael López Aliaga while avoiding a response regarding Luis Rubio’s resignation. Politician Daniel Urresti claimed it is false that mayors can resign from their posts.
