Philippines to create centralized database of foreign divorce laws

The Philippine Supreme Court, the Department of Foreign Affairs (DFA), and the Office of the Court Administrator (OCA) have signed a memorandum of agreement to establish a centralized repository of foreign laws regarding divorce and the annulment or nullity of marriage.

This initiative aims to streamline the process for Filipinos, particularly overseas Filipino workers (OFWs), seeking to have foreign divorce decrees recognized in Philippine courts. By providing access to authenticated and updated foreign family laws, the system is expected to reduce the time, legal costs, and complexities typically involved in proving foreign legislation during legal proceedings.

The OCA will maintain the repository and develop the access system, while the DFA will coordinate with Philippine embassies and consulates to secure authenticated copies of foreign laws and provide legislative updates. The project follows recent amendments to the Rules of Court designed to simplify how Filipino spouses establish the existence and terms of a foreign divorce.
