Piura Municipality recovers property after 15 years of illegal occupation

The Provincial Municipality of Piura has successfully recovered a 2,700 m² property in the Industrial Zone that had been illegally occupied since 2011. The recovery was executed through an extrajudicial procedure established by Law No. 30230, supported by municipal machinery and the National Police of Peru.

Municipal Prosecutor Edson Montalbán Sandoval noted that the intervention was made possible after a lawsuit filed by the occupants was definitively archived in 2022 and a legal annotation in Public Registries was lifted. The municipality intends to use the land for the Management of Transport and Urban Mobility to install infrastructure for driver licensing exams and administrative services.

In Peru, property owners have several legal avenues to recover illegally occupied real estate, including extrajudicial defense (which must be requested within 15 days of dispossession with police support), interdicts, notary-based express evictions for lease agreements, and judicial eviction processes.
