Piura transporters sue municipal decree over photo‑ticket system

Transporters in Piura, Peru, have filed an action of popular demand to declare the municipal decree that introduced a photo‑ticket (fotopapeleta) system unconstitutional. The demand, led by sector representative Miguel Chunga, argues that the municipality lacks authority to impose administrative sanctions through a local decree and cites previous Constitutional Court rulings.

The decree, numbered 005‑2026, would allow electronic cameras to issue fines of 650 to 1,250 soles for speed violations and signal infractions. Over 80,000 drivers could be affected. Transporters also contend that the city’s roads are in poor condition, making electronic enforcement impractical, and they call for infrastructure improvements before any such system is applied.

A single hearing is expected within the next month, with a final decision anticipated within two months. If successful, the decree would be nullified, removing the photo‑ticket fines for transport operators in Piura and surrounding districts.
