Podgorica High Court halts several criminal proceedings due to insufficient evidence

The High Court in Podgorica has recently issued several decisions to halt criminal proceedings following reviews of indictments. These rulings have sparked discussions regarding the relationship between prosecutorial investigations and judicial oversight of evidence.

Defense attorney Mihailo Volkov noted that these decisions suggest a more rigorous judicial approach to verifying sufficient evidence before indictments are confirmed. One notable case involved Jovan Martinović and Andrej Nedović, who faced charges of abuse of position in business involving approximately 20 million euros for the company Uniprom. The court halted the proceedings after determining there was insufficient evidence to support the charges.

Similar outcomes occurred in a case involving several other individuals, including Aleksandar Mijajlović and Predrag Bošković, where the court found a lack of evidence to establish reasonable suspicion. These rulings are significant as some defendants had previously spent months in detention while facing intense public scrutiny regarding the validity of the State Prosecutor's Office's claims.
