Poland: Authorities can inspect private properties for illegal waste burning

In Poland, authorities have broad powers to investigate illegal waste burning and violations of anti-smog resolutions. Residents experiencing issues with thick, chemical-smelling smoke or soot from neighboring properties can request inspections.

Under the Environmental Protection Law, authorized inspectors—including municipal guards or officials appointed by local mayors or presidents—have the right to enter private properties and boiler rooms between 6:00 and 22:00. They are permitted to request heating documentation, fuel certificates, and take ash samples for laboratory testing.

Penalties for burning prohibited materials, such as plastics, lacquered wood, or furniture boards, are significant. While an official fine during a mandate proceeding may be up to 500 PLN, cases referred to a district court can result in fines reaching 5,000 PLN. Furthermore, obstructing or preventing an authorized environmental inspection is a criminal offense under the Penal Code.
