Poland: Commissioner reminds municipalities of free transport duties for disabled students

The Commissioner for Human Rights in Poland has issued reminders to municipalities regarding their legal obligations to provide free transport and care for students with disabilities. A recent social study and report highlight ongoing systemic issues, including complaints about transport organization, reimbursement of costs, and the quality of care provided during transit.

According to the findings, approximately 26 percent of municipalities failed to inform parents of their rights, and about one-quarter of surveyed students lacked a designated caregiver during travel. The Commissioner emphasizes that providing a school placement is insufficient if a student cannot safely and regularly reach a facility that meets their specific needs.

Legal requirements dictate that transport must be provided to the “nearest” appropriate school, which is defined by the student's specific educational needs rather than mere geographic proximity. Furthermore, the person driving the vehicle should not simultaneously serve as the student's caregiver.
