Poland: Dispute over Maciej Berek's Constitutional Tribunal appointment

A dispute has emerged between the Polish Presidential Chancellery and the Sejm regarding the appointment of Maciej Berek to the Constitutional Tribunal. Zbigniew Bogucki, head of the Presidential Chancellery, has issued a follow-up request to the Marshal of the Sejm seeking detailed information and documentation to verify that Berek meets the formal legal requirements for the position.

The Presidential Chancellery maintains that reviewing these requirements is a constitutional duty to ensure the continuity of power and the protection of the Constitution. President Karol Nawrocki has indicated he will not invite Berek to take the oath of office until documentation confirming the required professional seniority as a legal advisor is provided.

In response, the Sejm's Chancellery has rejected these objections, stating that the President lacks the competence to challenge the Sejm's selection process. Maciej Berek has also stated that the necessary professional documents are publicly available and were presented during the parliamentary procedure. Legal experts suggest that if the statutory requirements are not verified, the President may be legally obligated to withhold the oath.
