Poland Ministry of Justice proposes judicial disciplinary reforms

The Polish Ministry of Justice has published a legislative project aimed at reforming the judicial disciplinary system and amending laws regarding the organization of common courts, the prosecution, and the Supreme Court.

A primary objective of the proposal is to prevent judges from being penalized for questioning the status of certain judges or the legality of specific chambers within the Supreme Court. The project also seeks to reform disciplinary courts by reducing the competencies of the Chamber of Professional Responsibility.

Under the new proposal, the method for appointing disciplinary spokespersons would change. Instead of being appointed solely by the Minister of Justice, candidates for the chief spokesperson and deputies would be selected by Judges' Assemblies at the Court of Appeal level. Local disciplinary spokespersons would be selected by Judges' Assemblies at the District Court level.
