Poland: New rules allow Swiss franc loan borrowers to suspend installments
New regulations regarding Swiss franc (CHF) mortgage disputes in Poland have introduced significant changes for borrowers. As of August 7, 2026, certain consumers no longer need to file a separate application for security to suspend loan installments during legal proceedings.
The mechanism is triggered upon the delivery of a lawsuit to the bank by the borrower, or the delivery of a counterclaim to the bank. Once triggered, the law prohibits banks from collecting installments or debiting the consumer's account.
However, there is a critical limitation: banks are not required to accept installment payments if the total amount already paid by the consumer is less than the original credit amount provided by the bank. This means the ability to suspend payments depends on the specific repayment history and the total amount transferred to the borrower.
