Polish government proposes to make balconies common property in apartment blocks
The Polish government has drafted a bill to amend the Act on ownership of premises so that structural elements of balconies, loggias and terraces become part of the building’s common property. Under the proposal, repair costs for the balcony slab, insulation, balustrades and other structural components would be financed from the monthly advance payments made by all owners of a block, proportionally to their shares, regardless of whether a particular flat has a balcony. Interior finishes – such as tiles, paint, decking or personal accessories – would remain the private responsibility of the individual owner.
The reform is expected to affect roughly 3.3 million residents of multi‑unit buildings. While the bill is still a draft and not yet law, it would also allow co‑ownership associations to set higher advances for specific units if needed. The plan does not grant communities new powers to ban activities such as smoking or drying laundry on balconies, according to real‑estate advisor Tomasz Błeszyński.
