Poland plans to increase energy concession fees to boost budget

The Polish government is preparing a legislative amendment to the Energy Law that would significantly increase concession fees for energy and fuel companies. The project, currently under review by the Council of Ministers, is expected to be adopted in the fourth quarter of 2024.

Key changes include raising the minimum annual concession fee from 1,000 PLN to 5,000 PLN. Additionally, the coefficient used to calculate the fee based on electricity sales revenue is proposed to increase tenfold, from 0.0005% to 0.005%. The government also plans to abolish the current 2.5 million PLN cap on these fees, meaning larger market players will pay amounts proportional to their turnover without an upper limit.

The Ministry of Energy estimates these changes will generate approximately 3.564 billion PLN in additional annual revenue for the state budget. While the primary target is energy enterprises, there are concerns that these increased operational costs may be passed down to individual consumers through higher electricity and gas bills.
