Poland property laws govern allotment gardens and boundary construction

Legal regulations in Poland dictate specific constraints regarding construction and land use on private and allotment plots. Building a house on a Family Allotment Garden (ROD) plot is prohibited, as users hold only leasehold rights rather than ownership. The land remains the property of the municipality or the State Treasury, and individual gardeners lack the authority to change land designation for residential purposes.

Regarding construction near property boundaries, owners may install fences up to 2.2 meters high on their own land without neighbor consent or official notification. However, shared fences along a boundary line require mutual agreement. For buildings, standard regulations require a 3-meter distance from the boundary if walls lack windows or doors, increasing to 4 meters if openings are present. Certain exceptions exist under local spatial management plans, which may allow garages or utility buildings up to 6.5 meters long and 3 meters high to be placed closer to the boundary.
