Poland: Regulations for Family Allotment Gardens

Regulations governing Family Allotment Gardens (ROD) in Poland outline specific prohibitions and requirements for plot holders. Under the ROD Act, residential living and conducting business activities on allotment plots are strictly prohibited. Garden associations have the authority to terminate lease agreements if a gardener continues to reside on the plot or conduct business despite receiving a written warning. Other grounds for termination include destroying garden infrastructure, persistent disruption of order, or failing to pay garden fees for at least six months after receiving a written notice.

Additionally, specific rules govern the placement of garden structures. Composters, which are mandatory for organic waste, must be placed at least 1 meter away from the plot boundary and in a discreet, shaded area to maintain aesthetics and prevent odors. Similar distance requirements apply to greenhouses, foil tunnels, and pergolas. Foil tunnels are restricted to a maximum height of 3 meters and cannot exceed 20 percent of the total plot area. Garden boards may order the dismantling of structures that violate these rules or are deemed unsightly.
