Poland implements EU Digital Services Act and Data Act

The Polish Senate has passed legislation to implement the European Union’s Digital Services Act (DSA) and the Data Act, aimed at strengthening digital security and data protection. The new laws introduce faster procedures for responding to illegal online content, such as hate speech and incitement to violence. In urgent cases, internet platforms will be required to provide evidence to authorities within 24 hours, a significant reduction from the previous 14-day window.

The President of the Office of Electronic Communications (UKE) will serve as the digital services coordinator, overseeing compliance, handling complaints, and issuing sanctions. Additionally, the government is introducing the ‘Cyber Piątka’ package to enhance cybersecurity for companies handling sensitive data, including medical firms.

The legislation has faced political scrutiny. Digital Affairs Minister Krzysztof Gawkowski has called for the President to sign the DSA implementation to allow for stricter enforcement against platforms, while President Karol Nawrocki has expressed concerns regarding potential limitations on freedom of speech and the power of officials to decide what content is acceptable.
