Poland spatial planning disputes: Court ruling and reform impact

The Supreme Administrative Court has overturned a ban on the construction of three service buildings in Mechelinki, a coastal area. The ruling follows a dispute where the Pomeranian Voivode had previously revoked building permits, citing that the developer used questionable design solutions to bypass local zoning laws. Specifically, the project was accused of using flat roof elements and external stairs to circumvent requirements for pitched roofs and to stay within the 20 percent building coverage limit.

Separately, Poland's spatial planning reform is causing significant issues for landowners. As municipalities transition to new general plans, many plots previously designated for construction are being reclassified into zones where building is prohibited. While existing building permits may allow for the completion of a structure, owners face restrictions on adding garages, extensions, or even solar panels. As of mid-September, fewer than half of Poland's 2,479 municipalities have completed these new planning documents.
