Poland's Justice Ministry says balcony smoking can be a misdemeanor

The Polish Ministry of Justice answered a parliamentary interpellation, stating that smoking on a balcony that repeatedly disturbs neighbours may be treated as a public nuisance under Article 51 § 1 of the Penal Code. Such conduct can be classified as a misdemeanor, punishable by a fine of up to 5,000 zł, with city police or municipal guards able to issue on‑the‑spot penalties of up to 500 zł. The Ministry of Health also issued guidance on the matter in July 2026.

Neighbouring residents can report nuisance behaviour – including smoke, grill fumes, or loud music – to the municipal guard, providing photos or video as evidence. Authorities assess the frequency, intensity and duration of the disturbance before deciding on an intervention. While a single noise incident is usually tolerated, prolonged or repeated disturbances may trigger the same legal provisions, which do not depend on a specific night‑time cutoff.
