Police not required to announce speed radar controls

Legal experts and authorities in Montenegro and the Czech Republic have clarified that police are not legally required to provide advance warning signs for speed radar controls.

In Montenegro, following recent amendments to the Law on Road Traffic Safety that increased penalties for speeding, lawyer Neda M. Vuksanović noted that while drivers must obey speed limits, the state is not obligated to mark every radar location. However, she suggested that if warning signs are used inconsistently across different road sections, the state should provide clear criteria for such decisions to ensure equal treatment of all drivers.

Similarly, in the Czech Republic, the Ministry of Transport and police officials confirmed that officers are permitted to conduct speed measurements from positions that are not easily visible to drivers, such as behind street lamps, parked vehicles, or bushes. Officials stated that no regulations exist requiring officers to announce speed checks or maintain a specific distance from the roadway, provided the measuring equipment has a clear view of the passing vehicle.
