Polish apartment owners face costly rules for air‑conditioner installation

In Poland, installing an external air‑conditioning unit on a single‑family house requires no building permit, but the same is not true for multi‑unit blocks. The façade, roof, balcony slab and other common elements belong to the condominium, so owners must obtain written consent from the owners’ association, cooperative or building manager before mounting the unit. Applications normally must include technical data, noise level and drainage plans, and decisions are issued within 14‑30 days, sometimes longer for larger cooperatives.

If the condenser is placed on a balcony without proper drainage, water may flow onto lower‑level neighbours. Polish law holds the installer and unit owner civilly liable for any damage, and the condominium can demand removal of the device. Courts have ordered demolition of illegally installed units even when owners incurred installation costs. Potential installers are not required to verify the consent, placing full responsibility on the property owner to secure approvals and ensure proper condensation management.
