Polish Constitutional Tribunal appointment sparks political dispute

A political dispute has emerged in Poland regarding the appointment of Maciej Berek as a judge to the Constitutional Tribunal. Following his selection by the Sejm, concerns have been raised about whether the President will refuse to administer the required oath of office.

Sejm Marshal Włodzimierz Czarzasty criticized the potential refusal, stating that the President does not have the legal authority to contest the Sejm's sovereign decision. Czarzasty warned that interfering with the appointment would violate the constitutional separation of powers and cautioned that the President should be held to the constitution.

Bogdan Święczkowski, President of the Constitutional Tribunal, addressed the situation by stating that if the President administers the oath, he will be compelled to accept Berek into service. Święczkowski noted that while there are significant doubts regarding Berek's formal qualifications, he intends to follow the law and 'clench his teeth' to allow the judge to assume his duties if the oath is taken.
