Polish Constitutional Tribunal officials spark controversy over legal statements

Bogdan Święczkowski, President of the Polish Constitutional Tribunal, has drawn criticism following comments regarding the investigation into the Justice Fund. In a recent interview, Święczkowski suggested that prosecutors conducting the investigation should face serious criminal liability and remarked that Donald Tusk should have been imprisoned. Legal experts, including constitutional scholar Dr. Joanna Juchniewicz, have characterized these statements as potential threats intended to intimidate prosecutors, noting that such conduct could lead to disciplinary action against the judge.

Separately, former Constitutional Tribunal President Julia Przyłębska has defended the institution's procedures. She criticized interpretations that would allow judges to take their oaths without the physical presence of the President, calling such approaches a 'parody.' Przyłębska also addressed concerns regarding the professional qualifications of judicial candidates and defended the finality of the Tribunal's rulings, rejecting claims that the court's decisions are politically motivated.
