Poland's Constitutional Tribunal president demands police explanation for July 14 intervention

Bogdan Święczkowski, president of Poland’s Constitutional Tribunal (TK), wrote to Police Chief Marek Boron asking for a detailed justification of the police operation that took place on 14 July at the Tribunal’s headquarters. He requested the legal basis for the police entry, the identity of the person who reported the alleged incident, and copies of all related police notes, protocols and other official documents.

Święczkowski warned that the police presence – which included a dozen officers and a prosecutor – may have infringed the constitutional guarantees of the Tribunal’s independence (art. 173) and the judges’ impartiality (art. 195). He stressed that the police, as part of the executive branch, have no authority to decide who may attend the General Assembly of judges, which was scheduled to discuss the Tribunal’s 2024 budget but failed to achieve quorum after two judges left the session.

The president framed the request as a constitutional duty to protect the safety and autonomy of the court’s work, noting that any external interference could constitute a breach of constitutional norms.
