Polish court blocks tax on housing community advertising revenue
The Wrocław Provincial Administrative Court has blocked a controversial attempt by tax authorities to tax residents of housing communities on income generated by the community, such as advertising revenue from building facades.
Previously, the tax office argued that even if funds were used entirely for building renovations and not distributed to individuals, the reduction in maintenance costs constituted a financial benefit for property owners. This approach would have required residents to issue PIT-11 forms despite receiving no direct cash. The court's ruling rejects this interpretation, preventing residents from being taxed on communal funds used for collective property improvements.
