Polish court ruling enables waste fee refunds for residents

A final ruling by the Supreme Administrative Court in Poland has opened a path for housing cooperatives to recover overpaid waste management fees and refund them to tenants. In the case of the Przylesie Housing Cooperative, this could involve nearly 2.4 million PLN, with individual residents potentially receiving between 250 and 650 PLN each.

The court determined that the Tax Ordinance, rather than the Act on Maintaining Cleanliness and Order in Municipalities, should govern how waste management fee applications are processed. While the Lubin municipality maintains that its previous methods were not errors and followed the literal wording of the law, the ruling is considered a precedent that may allow other cooperatives and single-family homeowners to seek similar claims.

Separately, local governments are advocating for the UC100 act regarding extended producer responsibility (ROP). Proponents argue this legislation could lower waste management costs for families by up to 240 PLN, though legislative progress remains stalled at the government level.
