Polish court rulings address property disputes and rental damages
Two separate legal and property disputes in Poland have highlighted complexities regarding property rights and rental responsibilities.
In Osieczna, a court ruling involving a property owner, Tadeusz, determined that no violation of domestic peace occurred when his nephew occupied a house Tadeusz had inherited but did not reside in. Despite Tadeusz holding a valid will, the court found that because he did not live in the house daily, the nephew's occupation did not constitute a breach of domestic peace. The decision by the District Court in Leszno was upheld by the Regional Court in Poznań.
In a separate incident in the Masuria region, a couple renting a wooden holiday home via OLX was charged 1,000 PLN by the owner for moisture appearing on bathroom walls after several days of use. The tenants refused to pay, arguing the moisture resulted from normal usage and inadequate ventilation systems, a common issue in budget seasonal rentals where proper ventilation shafts are often replaced by ineffective electric fans.
