Polish courts rule on pharmacy licensing and sales violations

Legal disputes regarding pharmaceutical regulations and licensing are surfacing in Polish courts. In one case, the Wielkopolski Provincial Pharmaceutical Inspector revoked a pharmacy's permit after discovering that a building, previously reported as undergoing renovation, had actually been demolished. Although the company claimed to have established a new, fully equipped premises and sought to reactivate its status in the Pharmacy Register, the matter has moved into an appeal process before the Chief Pharmaceutical Inspector and administrative courts.

In a separate ruling, the Supreme Administrative Court upheld a fine imposed by the Chief Pharmaceutical Inspector on a pharmacy in the Świętokrzyskie Voivodeship. The pharmacy had exceeded legal limits for single-instance sales of over-the-counter medications. The court rejected the pharmacy's defense that a long-term IT system failure should mitigate the penalty, instead ruling that the prolonged nature of the technical failure served as an aggravating circumstance.
