Polish labor regulations regarding vacation leave and work breaks

Under the Polish Labor Code, specific regulations govern how employees manage overdue vacation days and work breaks. Regarding overdue leave, employers are obligated to ensure employees use unused vacation from the previous year by September 30 of the following year. This deadline refers to the actual commencement of the leave, not merely the submission of a request. Failure to comply can result in fines for employers ranging from 1,000 to 30,000 PLN. While employees do not lose their right to leave after the September deadline, employers have the authority to mandate its use.

Regarding work breaks, the law stipulates a minimum break of 15 minutes for shifts lasting at least 6 hours. For shifts exceeding 9 hours, an additional break is required, with further breaks applicable after 16 hours. These breaks are included in paid working time. While 15 minutes is the legal minimum, employers may implement longer breaks, such as 30 or 60 minutes, provided these are established in the company's work regulations or collective agreements. Employees cannot unilaterally decide to extend their breaks beyond the established workplace rules.
