Polish pension rules regarding mandate contracts and study periods
In Poland, mandate contracts (umowa zlecenie) generally contribute to pension capital through social security contributions. However, exceptions exist for students under 26 who are exempt from these contributions, meaning such periods do not count toward their future pension. Additionally, if a contractor is already employed elsewhere with a salary exceeding the minimum wage, only health insurance contributions are mandatory, which also affects pension accumulation.
Regarding work seniority, mandate contracts count toward seniority if mandatory pension and disability contributions were paid. This seniority can influence employee rights, such as the length of annual leave.
Furthermore, periods of university study are included in the total seniority required for retirement, categorized as non-contributory periods. For women, the required seniority is 20 years, and for men, it is 25 years. To claim these periods, individuals must provide documentation such as a university certificate or a diploma containing specific details regarding the duration and completion of the studies.
