Polish retiree wins long-standing legal battle against ZUS

A Polish retiree has won a long-standing legal battle against the Social Insurance Institution (ZUS) regarding undervalued pension benefits. After an 18-year dispute, a court ruled in favor of the former miner, granting him an 18,000 PLN lump-sum adjustment and a higher monthly pension.

The case highlights a systemic issue potentially affecting up to 200,000 seniors in Poland. The dispute stems from 2012 regulation changes that deducted previously paid benefits from pension capital, reducing final payouts. While the Constitutional Tribunal ruled in June 2024 that this practice violates the principle of trust in the state, ZUS has not implemented the decision, allegedly because the ruling was not published in the Journal of Laws.

Consequently, affected individuals, including many teachers and certain age cohorts of men and women, must file individual claims for recalculation and pursue court action if denied.
