Poland Sejm passes windfall tax on fuel corporations
The Polish Sejm has passed a law to impose a windfall tax on fuel corporations to fund the 'Ceny Paliwa Niżej' consumer protection program. The tax, which applies a 60% rate to producers and 50% to non-producer sellers, is intended to capture extraordinary profits earned between March 2026 and March 2027.
In response to rising fuel costs, President Karol Nawrocki has submitted a separate legislative proposal to the Sejm. This presidential bill aims to lower retail prices by implementing fixed monetary limits on refinery, import, and sales margins rather than percentage-based margins. It also proposes temporary VAT and excise tax exemptions and defines market disruptions as a minimum 20% increase in Brent crude prices compared to the previous year's average.
A political dispute has emerged between the government led by Donald Tusk and President Nawrocki. The government argues that the President's previous decision to refer a similar windfall tax law to the Constitutional Court—on the grounds of its retroactive nature—has hindered efforts to lower fuel prices. Conversely, critics suggest the government is using the tax to shift responsibility for high prices onto the presidency.
