Polymarket faces renewed CFTC investigation over US access and advertising

The Commodity Futures Trading Commission (CFTC) has reopened an investigation into Polymarket to determine if the prediction market operator violated a 2022 enforcement settlement. The settlement required the company to block United States users from its offshore platform.

The renewed probe is part of a broader inquiry opened earlier this year. Investigators are reportedly examining the adequacy of Polymarket’s geofencing and location-detection controls, as well as its advertising activities within the U.S. Additionally, regulators are scrutinizing the onboarding processes and customer protections on Polymarket’s separate, onshore U.S. platform which launched late last year.

This scrutiny follows reports regarding Polymarket’s marketing practices, including allegations that the company paid social media influencers to promote staged or fictitious wagers. The company has responded by increasing compliance efforts, including the establishment of a 16-person investigations team to monitor suspicious activity and potential insider trading.

Polymarket is headquartered in New York and operates its offshore exchange through an entity registered in Panama. While previous investigations by the CFTC and the Department of Justice were closed in 2025 without charges, this new inquiry seeks to address ongoing concerns regarding regulatory compliance and market integrity.
