Port of Valencia expansion cleared by Valencian High Court

The High Court of Justice of the Valencian Community (TSJCV) has dismissed a legal challenge regarding the environmental requirements for the expansion of the Port of Valencia. The court ruled that the environmental impact assessment (DIA) issued on July 30, 2007, remains valid for the 2021 project proposal for a new container terminal, which carries a tender budget exceeding 660 million euros.

Magistrates determined that the modifications in the 2021 project do not constitute a new project requiring a fresh environmental assessment, as they do not introduce innovations that would cause significant adverse effects on the environment. The ruling clarifies that the works are part of a single continuous project.

Despite this ruling, legal challenges persist. The platform Comissió Ciutat-port has announced intentions to appeal to the Supreme Court. Additionally, a separate legal proceeding is active in Madrid, where Ecologistas en Acción is challenging the dredging operations in the ports of Valencia and Sagunt, arguing these activities lack a specific environmental evaluation.
