São Paulo Court declares July 2024 zoning law revision unconstitutional
The São Paulo Court of Justice (TJ-SP) has declared the July 2024 revision of the city's zoning law unconstitutional. This decision, reached by the court's Special Body following an action by the Public Ministry of São Paulo (MPSP), restores the previous zoning regulations that were enacted in January 2024.
The court ruled that the July revision was invalid because it included 32 amendments and new articles that significantly altered urban structuring and land use without the required public hearings or technical studies. Judges noted that the revision went beyond the original scope of making minor adjustments, representing a formal defect in the legislative process by the City Council.
The ruling will not immediately invalidate existing projects. Building permits and construction works that were already licensed or had applications filed under the July 2024 rules will remain valid. The new regulations will take effect once the court's decision is officially published.
