Portugal outlines legal obligations for workers with a second job
Portuguese labour law does not prohibit employees from holding more than one job, but the Code of Labour imposes duties of loyalty and forbids conflicts of interest. Under article 128 of Law 7/2009, workers must not compete with their employer or disclose confidential information. Each contract is subject to the 48‑hour weekly maximum set out in article 211, so while total hours can exceed 48 through multiple jobs, no single job may breach the limit.
Tax and social‑security rules differ by employment type. Workers with two salaried contracts have all contributions automatically deducted and must consider the impact on their annual IRS filing. Those combining salaried work with independent ("recibo verde") activity must file separate IRS annexes and only pay tax on independent income above €12,500. Social‑security contributions are waived for independent earnings if the monthly amount is below four times the IAS and other conditions regarding distinct employers and coverage are met.
