Portugal traffic laws: Mobile phone use and penalties

In Portugal, many drivers are facing fines for mobile phone use due to a lack of awareness regarding legal exceptions. Under Article 84 of the Highway Code, the continuous handling of any device that may impair attention while driving is prohibited. This includes smartphones and traditional headphones.

Violators face financial penalties ranging from 250 to 1,250 euros, the automatic loss of three driving points, and the potential for driving bans. Drivers may also face civil and criminal liability for damages caused by distraction.

Legal exceptions allow for communication via hands-free systems, such as single-earpiece audio devices, built-in microphones, or equipment that does not require continuous handling. Use is also permitted during driving instruction and official practical exams.
