Posto Bacanga ordered to compensate consumers for adulterated gasoline

A court in São Luís has ordered Posto Bacanga to compensate consumers after it was found to be selling adulterated gasoline. The ruling, issued by Judge Douglas de Melo Martins, follows an inspection by the National Agency of Petroleum, Natural Gas and Biofuels (ANP) in November 2022.

Testing revealed that the common gasoline sold at the station contained 71% anhydrous fuel ethanol (EAC), significantly exceeding the legal limit of 27%. The inspection also noted missing mandatory documentation, including fuel movement logs, purchase invoices, fire department certificates, and operating licenses.

As part of the sentence, the establishment must pay R$ 300,000 in collective moral damages to the State Fund for the Protection of Diffuse Rights (FEPDD). Additionally, individual consumers who can prove they refueled at the station during the inspected period are entitled to R$ 1,000 in compensation, alongside reimbursement for proven material damages such as increased fuel consumption or mechanical issues.
