Power Expectations alleges misconduct in Puerto Rico energy contract dispute

Power Expectations LLC is calling for a formal investigation into attorney Javier Vázquez Morales, a partner at O’Neill & Borges and legal adviser to the Financial Oversight and Management Board. The energy supplier alleges a pattern of improper conduct, conflicts of interest, and potential corporate espionage regarding a cancelled $5.8 billion contract for a 400-megawatt temporary emergency power facility at the Aguirre power station in Salinas.

The allegations surfaced following testimony by Josué Colón Ortiz, the Energy Czar and Public-Private Partnerships Authority Executive Director, before the Puerto Rico House of Representatives. Power Expectations claims Vázquez made inappropriate attempts to influence Colón regarding the contract. Specifically, the firm alleges Vázquez claimed that Enchanted Rock, a member of the Power Expectations consortium, had been “apparently erroneously included” in the group, despite Vázquez having prior knowledge of the formal agreements between the two entities.

Power Expectations has filed a lawsuit against the Puerto Rico Electric Power Authority (PREPA) to overturn the decision to cancel the temporary energy contract. The dispute also involves allegations of improper contact with Flotek Industries, the company that replaced Enchanted Rock in the arrangement.
