Prague Court rejects Diamo lawsuit against Ministry of the Environment
The Prague Municipal Court has rejected a lawsuit filed by the state enterprise Diamo against the Ministry of the Environment. The legal dispute concerned the construction of an air separation wall at the Heřmanice landfill in Ostrava, which was intended to prevent the landfill from igniting toward a nearby chemical waste site.
Diamo had previously filed a criminal complaint alleging that the wall's filling material was flammable and did not meet required standards. The wall was constructed by Ridera Bohemia between 2014 and 2022. However, police closed the case after a year, determining no crime had been committed, and the Czech Environmental Inspectorate (ČIŽP) maintained that expert reports confirmed the wall's functionality.
The court dismissed Diamo's lawsuit on procedural grounds, specifically noting that the misdemeanor proceedings against the contractor had already been terminated. The Ministry of the Environment stated that the court's decision confirms its actions were lawful and that the termination of the proceedings did not infringe upon Diamo's subjective public rights.
