Brazil's CCJ approves regulation for logistics operators

The Constitution, Justice and Citizenship Commission (CCJ) of the Brazilian Chamber of Deputies has approved a bill to regulate the activities of logistics operators in Brazil. The proposal, based on Bill 3757/20, aims to establish legal norms for a sector that provides integrated services including transport, storage, and inventory management for the industrial, commercial, and agricultural sectors.

Relator Deputy Marangoni (Pode-SP) presented a favorable opinion on the substitute text. Key modifications approved by the commission include the removal of the right for professionals to withhold goods in the event of payment delays and the exclusion of an article regarding the timeframe for requesting compensation for damages related to logistics contracts.

The regulation defines logistics operations as an integrated business activity covering all transport modes and any type of storage. It also stipulates that operators must comply with current insurance legislation for road freight transport and remain responsible to contractors for direct damages caused by their employees. As the project was approved in a conclusive manner, it may proceed directly to the Senate unless an appeal is filed for a vote in the Chamber's Plenary.
