Productos EPA Colombia fined $140 million for e-commerce violations
The Superintendencia de Industria y Comercio (SIC) has fined Productos EPA Colombia S.A.S. approximately $140.4 million for violating consumer protection laws during online sales. The investigation identified several failures regarding electronic commerce regulations under Law 1480 of 2011.
Key violations included improper warranty policies, where the company attempted to exclude responsibility for products purchased through third-party distributors, contradicting the principle of joint liability. Additionally, the company failed to provide essential product information, such as the right of withdrawal (derecho de retracto) and its corresponding procedures, before customers accepted offers.
The SIC also noted that the company’s website lacked a visible and easily identifiable link to the consumer protection authority and failed to inform customers about their right to payment reversal for certain electronic purchases.
