Property Law clarifies parking and electric charger rules

Under the Horizontal Property Law, homeowners face specific regulations regarding the use of parking spaces and the installation of electric vehicle charging points in community garages.

Regarding parking, owners may park both a car and a motorcycle in a single space provided both vehicles remain entirely within the designated lines and do not obstruct neighbors or common areas. However, community statutes may expressly prohibit parking more than one vehicle per space. Legality also depends on fire safety, insurance coverage, and garage licensing.

For electric vehicle charging, the Supreme Court has affirmed that owners can install charging points without requiring a community vote. The owner must simply communicate the installation to the community in advance. The installer is responsible for all costs, including equipment, wiring, maintenance, and electricity consumption. If the installation requires crossing common elements, it must be done without causing damage or unnecessary nuisance to other residents.
