Property laws regarding neighbor fence disputes in Poland
Under Polish civil law, the placement and cost-sharing of fences between neighboring properties depend on the exact location of the boundary. If a fence is built entirely on one person's land, that owner decides on the design and bears all costs. However, structures located exactly on the property line are generally considered for joint use, and neighbors should share maintenance costs.
Disputes often arise when one neighbor builds a new fence on the boundary and demands half the payment without prior agreement. To avoid conflict, neighbors should agree on the scope, price, and cost-sharing before construction begins.
If a neighbor builds a fence that encroaches on another person's land, the property owner has the right to demand the removal of the violation or the restoration of the boundary. While the Civil Code allows for certain forms of self-help to restore a previous state, owners should not unilaterally dismantle a neighbor's fence after a long period of time. Instead, legal procedures such as boundary demarcation or court action are recommended to resolve disputes regarding land occupation.
