Propertymark calls for clearer rent tribunal guidance

Industry body Propertymark has called for improved guidance and clarity regarding the tribunal process following the enactment of the Renters’ Rights Act. The call comes as rent tribunal cases surge in England.

Under the Act, private tenants can challenge rent increases through the First-tier Tribunal. To alleviate pressure on the tribunal system, the government announced that HMRC’s Valuation Office will take responsibility for making initial decisions on rent increase challenges.

Greg Tsuman, Past President of ARLA Propertymark, emphasized the need for simpler forms, practical advice for tenants, and qualified staff on the tribunal helpline. He noted that tribunals evaluate achieved rents rather than advertised asking rents, a distinction critical for both landlords and tenants.

Kim Lidbury, ARLA Propertymark President, advised letting agents to engage in proactive conversations with tenants before issuing Section 13 notices, particularly when tenants face financial difficulties, to help maintain positive landlord-tenant relationships.
