Manhattan prosecutors fight to sustain murder charges against Luigi Mangione
Manhattan prosecutors have filed a legal response opposing the dismissal of state-level murder and weapons charges against Luigi Mangione. The defense has sought to drop these charges, arguing that Mangione cannot be prosecuted twice for the same event under double jeopardy laws, following his August guilty plea to federal stalking and cyberstalking charges.
Prosecutors contend that the state and federal cases involve “different harms, different evils, different purposes, different crimes.” They argue that the legal elements of the federal stalking conviction do not overlap with the state’s second-degree murder charge, which is a violent felony. The Manhattan District Attorney’s office maintains that the state prosecution can proceed under a legal exception to double jeopardy.
Mangione, 28, admitted to traveling to New York to shoot UnitedHealthcare CEO Brian Thompson in December 2024, citing frustrations with the health insurance system and chronic back pain. A ruling from Judge Gregory Carro regarding the dismissal of the state charges is expected in late autumn.
