Próspera ZEDE appoints Alberto Hernández Franks as Civil Prosecutor

Próspera ZEDE has sworn in Honduran attorney Alberto A. Hernández Franks as its Civil Prosecutor. In this role, Hernández Franks will be responsible for enforcing the jurisdiction’s civil and administrative regulations, statutes, and internal rules. His duties include pursuing compliance actions before arbitration service providers, managing forced tax collection procedures, and ensuring the protection of life, property, and public order within the zone.

Hernández Franks is an alumnus of the National Autonomous University of Honduras and holds a Master of Laws (LLM) from Penn State University. He is also admitted to the New York State Bar. Próspera stated that this appointment is intended to strengthen its institutional structure and commitment to the rule of law and economic development governance.

The appointment occurs amid ongoing legal disputes regarding ZEDE (Employment and Economic Development Zones) in Honduras. On September 20, 2024, the Supreme Court of Justice ruled the unconstitutionality of decrees related to ZEDE constitutional reforms and organic laws. Despite this ruling, Próspera maintains a different legal position regarding the scope of national decisions and continues to develop its institutional framework in Roatán.
