Puebla legislators propose compensation for infidelity in prenuptial agreements
The Labor Party (PT) in the Puebla State Congress is promoting a legislative initiative to allow for economic compensation in cases of infidelity or unjustified abandonment of the home, provided such terms are included in prenuptial agreements.
Local deputy Xel Arianna Hernández García presented the proposal to reform the State Civil Code. The reform aims to expand the scope of prenuptial agreements beyond property regimes to include personal coexistence clauses. If approved, couples could formally agree on lifestyle rules, family organization, and the distribution of household responsibilities.
The initiative specifies that compensation for breaching marital duties must be expressly agreed upon, proportional, and respectful of human rights, ensuring that such agreements do not violate public order or human dignity.
