Quebec's judicial system has been defined by its Civil Code for 160 years, distinguishing the province's legal framework from the rest of Canada. The history of this system began on August 1, 1866, with the introduction of the ‘Code civil du Bas-Canada’. This document aimed to rationalize and simplify a fragmented legal landscape that previously relied on various sources, including the Custom of Paris and Roman law.

Approximately 125 years later, the ‘Code civil du Québec’ was adopted to replace its predecessor. This updated text introduced significant innovations, particularly regarding family law and the rights of persons. Legal experts note that Quebec was a pioneer in modernizing its code; in the early 1990s, the province undertook a comprehensive rewrite to adapt to contemporary realities, a process that served as a model for other jurisdictions.
