Quebec implements new mandatory consumer repair guarantee

A new “guarantee of proper functioning” has come into effect in Quebec, providing automatic and free repairs for various goods if they malfunction within a specified timeframe. This measure stems from 2023 legislation aimed at protecting consumers against planned obsolescence and promoting product durability, repairability, and maintenance.

The guarantee applies to 14 categories of new goods, including appliances and electronics. Coverage periods vary by product type: six years for stoves, refrigerators, freezers, air conditioners, and heat pumps; five years for washing machines, dryers, and dishwashers; four years for televisions; and three years for computers, video game consoles, cell phones, and tablets.

Under this law, consumers can seek free repairs from either the retailer or the manufacturer. The coverage includes parts, labor, and reasonable shipping or transport costs. However, it does not cover damages resulting from misuse or normal maintenance. To claim the guarantee, the consumer must demonstrate that the product ceased to function correctly during the covered period. The duration is calculated from the date of delivery.
